Returned Goods

1. Condition of Sale:
The sales of Rhosse Medical products and services ("Products") and the acceptance of any purchase order submitted by a purchaser of Products ("Purchaser") is expressly made conditional on Purchaser's assent to these Terms and Conditions of Sale (“Agreement”), and Rhosse Medical agrees to furnish the Products only upon the terms and conditions of this agreement. Any additional, different, or conflicting terms and conditions set forth in any documents issued by a purchaser at any time, including without limitation any purchase orders and any specifications are hereby objected to by Rhosse Medical, shall be wholly inapplicable to any sale of Products and shall not be binding in any way on Rhosse Medical. No waiver or amendment to the terms and conditions of this agreement shall be binding on Midmark unless made in a writing expressly stating that it is such a waiver or amendment and signed by Rhosse Medical.

2. Payment:
Rhosse Medical may, but is not obligated to, sell Products to a Purchaser on credit. In the event that Rhosse Medical sells Products on credit, then:
(a) payment in full shall be due and payable thirty (30) days from the date of invoice;
(b) in the event Purchaser fails to pay Rhosse Medical the purchase price within thirty (30) days of the date of invoice, Rhosse Medical shall cancel any pending order with no will be canceled free of charge by Rhosse Medical

3. Limited Warranty:
Each Product sold by Rhosse Medical is accompanied by one of the following limited warranties (3 year warranty for power procedure chairs), unless otherwise specified by Rhosse Medical (click on applicable limited warranty).

Returned Goods.

1. Goods will be accepted for return for the following reasons:

If shipment was made without Customer’s authorization;
If incorrect items were shipped;
If defective items were shipped;
If defective goods are covered by the standard warranty;
If the goods were sent on evaluation basis.

2. To return goods, contact a Customer Service Representative by telephone or e-mail sales@rhossemedical.com. Please have the following information:
a. Reason you wish to return the goods; b. Date of Receipt of Order; c. Customer’s Purchase Order and the Rhosse Medical invoice number;

3. Shipment must be returned prepaid by Customer. Freight collect shipments will not be accepted.

4. If Customer intends to return equipment ordered in error, the following restocking charges and terms will apply:

25% within 30 days from date of shipment;
Refurbishing and replacement charges will be added to the restocking charges for damaged or missing items;
No returns after 30 days;
No refunds will be made on customized instruments.
